Welcome to Tomo! These Terms of Service ("Terms") govern your use of the Tomo mobile application and website (collectively, the "Service") operated by Tomo ("we," "us," or "our"). By accessing or using Tomo, you agree to be bound by these Terms.

1. Acceptance of Terms

By downloading, installing, or using Tomo, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Service.

2. Description of Service

Tomo is an AI-powered Japanese language learning application designed for intermediate learners. The Service provides:

  • Conversational practice with an AI tutor
  • Voice-based interaction (speech-to-text and text-to-speech)
  • Vocabulary tracking and personalized learning
  • Flashcard review for encountered words
  • Grammar explanations and feedback

3. User Accounts

When you use Tomo, a unique anonymous identifier is created to track your learning progress. You are responsible for maintaining the security of your device and account access. You agree to:

  • Provide accurate information if you contact support
  • Keep your device secure to protect your learning data
  • Notify us immediately of any unauthorized access

4. Acceptable Use

You agree to use Tomo only for its intended purpose of language learning. You agree NOT to:

  • Use the Service for any illegal or unauthorized purpose
  • Attempt to probe, scan, or test the vulnerability of the Service
  • Interfere with or disrupt the Service or servers
  • Attempt to reverse engineer, decompile, or disassemble the app
  • Use automated systems or bots to access the Service
  • Share content that is offensive, harmful, or inappropriate
  • Attempt to bypass any security measures
  • Use the Service to harass, abuse, or harm others
  • Resell, redistribute, or commercially exploit the Service

5. AI-Generated Content

Tomo uses artificial intelligence to generate Japanese language responses and learning content. You understand and acknowledge that:

  • AI responses are generated automatically and may occasionally contain errors
  • The Service is designed for educational purposes and should supplement, not replace, formal language education
  • Grammar explanations and corrections are AI-generated suggestions and may not always be perfect
  • We continuously work to improve accuracy but cannot guarantee error-free content

6. Intellectual Property

The Service, including its original content, features, and functionality, is owned by Tomo and is protected by international copyright, trademark, and other intellectual property laws. You may not:

  • Copy, modify, or distribute the app or its content
  • Use our trademarks, logos, or branding without permission
  • Create derivative works based on the Service

7. User Content

When you use Tomo, you provide content through conversations. You retain ownership of the content you create, but you grant us a license to:

  • Process your messages to provide the Service
  • Store your conversation history to track learning progress
  • Use anonymized, aggregated data to improve the Service

9. Third-Party Services

Tomo integrates with third-party services including OpenAI and Google Cloud. Your use of these integrated services is subject to their respective terms and privacy policies. We are not responsible for the practices of these third parties.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. We do not warrant that:

  • The Service will be uninterrupted or error-free
  • All errors or defects will be corrected
  • The Service will meet your specific requirements
  • AI-generated content will be 100% accurate

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TOMO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, data, or use
  • Costs of substitute services
  • Any damages arising from your use of the Service

Our total liability shall not exceed the amount you paid for the Service in the twelve (12) months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Tomo and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

13. Modifications to Service

We reserve the right to modify, suspend, or discontinue the Service at any time, with or without notice. We may also update features, add new functionality, or change pricing. Continued use of the Service after changes constitutes acceptance of the modified terms.

14. Termination

We may terminate or suspend your access to the Service immediately, without prior notice, for any reason, including breach of these Terms. Upon termination:

  • Your right to use the Service will cease immediately
  • We may delete your data in accordance with our Privacy Policy
  • Provisions that should survive termination will remain in effect

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.

16. Dispute Resolution

Any disputes arising from these Terms or your use of the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration.

17. Changes to Terms

We reserve the right to update these Terms at any time. We will notify you of material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the new Terms.

18. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Tomo regarding the Service and supersede all prior agreements.
